Terms of Use
Every user offering video files or links to such files via the
PCKILLER website – either as an individual or as a video group, hereinafter called “active user” – explicitly warrants that the contained videos are not subject to third-party rights and do not violate third-party rights, or that he is entitled to offer the video files via the
PCKILLER website.
Furthermore, the active user warrants that all video scenes included in the video files are not subject to copyright collecting societies, and especially that no collecting society fees are incurred for streaming and downloading. The active user especially warrants that he himself is not a member of a collecting society, and, should he join a collecting society, the latter will notify the operator of any transferred rights of use. Otherwise, the active user shall hold the operator harmless of all collecting society claims, especially he shall pass on any income earned via the collecting society to the operator and will further take over additional costs like collecting society’s fees.
The active user hereby expressly grants free use or the video files to the operator.
Furthermore, the active user shall hold the operator harmless of all third-party claims asserted against the operators as a result of using the video files.
The active user shall permit the operator to use the submitted video scenes for listening and downloading from the Internet.
In particular, video files may be made available for free listening per streaming and downloading.
